                  KNOWN DELAYS & RESTRICTIONS

The following jurisdictions have imposed certain restrictions on how, and when research of criminal record information can be conducted. These are not the policies of Phoenix Research, but rather of the individual courts.
POTENTIAL DELAYS ARE NOT LIMITED TO THE JURISDICTIONS LISTED HERE
In jurisdictions that do not have public access to criminal record files, we must rely on the clerks' staff to perform the actual search of their respective criminal indices. While most clerks are highly trained in their individual jobs,
they are not criminal research specialists.  As a result, we are limited to the information as provided by the
clerks. This includes criminal case information details, or lack thereof and any "No Record Found" as well.

 

ALL AVAILABLE STATEWIDES – REGARDLESS OF STATE REQUESTED

Once submitted, the agency or entity conducting the search determines when it is complete
For those states that require a signed authorization, the search request will be delayed if the required signed release is not submitted on the same day as the actual request for search. Requests submitted without the required signed release will be closed after 24 hours as "UNABLE TO PROCESS WITHOUT SIGNED RELEASE"

DUAL COUNTY SEAT JURISDICTIONS IN ARKANSAS

ARKANSAS, CARROLL, CLAY, CRAIGHEAD, DESHA, FRANKLIN, LOGAN MISSISSIPPI, PRAIRIE, SEBASTION & YELL
Dual county seats -Both must be searched to provide a complete record check.
(Possible delays for files ordered from one or both courts for confirmation)

KERN COUNTY CALIFORNIA

DOB’S are masked or removed from Public view.
Search results on subjects with common names will be delayed as actual hardcopy files must be ordered to verify identity. Delays can range from 24 hours to several weeks, dependent on the age of the case.

LOS ANGELES COUNTY CALIFORNIA – A “CLERK SEARCH” JURISDICTION

A DOB is Required for any search conducted. A middle name, and / or initial is most helpful.
Los Angeles county is a unified / consolidated court system that encompasses the following municipalities:
ALHAMBRA, ANTELOPE, BURBANK, BEVERLY HILLS, CITRUS, COMPTON, CULVER CITY, DOWNEY, EAST LOS ANGELES, ELMONTE, GLENDALE, HUNTINGTON PARK, INGLEWOOD, LOS ANGELES, SOUTH GATE, LONG BEACH, HOLLYWOOD, SAN PEDRO, VAN NUYS, LOS CERRITOS, MALIBU, NEWHALL, PASADENA, POMONA, SOUTH BAY, SANTA MONICA, SANTA ANITA, WHITTIER, SAN FERNANDO, & WEST LOS ANGELES

MADERA COUNTY CALIFORNIA

Record information for this county is on index cards. Cards are often mis-filed, and are subject to destruction and illegibility.
Case files prior to 1995 are warehoused and must be ordered. Ordered files are currently retrieved only one time per week.

NAPA COUNTY CALIFORNIA – A “CLERK SEARCH” JURISDICTION

If a possible record match is found, there is typically a 1 to 6 day delay for confirmation of identity & availability of details.

PLACER COUNTY CALIFORNIA

Misdemeanor criminal index is on 3x5 index cards. These cards are subject to loss, destruction, and illegibility.
Researchers are restricted to 5 files per day.

SANTA CLARA COUNTY CALIFORNIA – CLERK ASSISTED SEARCH

Specific record information must be ordered from the clerk

SAN FRANCISCO COUNTY CALIFORNIA

The Superior court charges a $5.00 fee for files that must be retrieved from their warehouse storage facility.
This is typically for any case file that is 18 months old, or older.

SACRAMENTO COUNTY CALIFORNIA – CLERK ASSISTED SEARCH

Criminal index does not have identifiers listed. Any file with a name match must be reviewed.
Files older than 2 years must be ordered.(3 to 5 day delay)

 

COOK COUNTY ILLINOIS

This jurisdiction uses their own unique tracking system; Most cases are indexed by"I.R.C." number (Fingerprint card numbers)
A D.O.B. will help to avoid any additional delay when ordering files for verification of identity.
All "name match only" files are ordered for review, to match the D.O.B. you provide.
Due to incomplete, or mis-matched information on computer index, more files need to be ordered than not.

 

MONROE COUNTY INDIANA

Effective July 14th 2003 - Social Security Numbers have been masked or removed from public view on the public access system in this jurisdiction. Delays are likely as a result of files ordered.

 

BROWARD COUNTY FLORIDA

Criminal records with a disposition of Nolle Prosecution, Adjudication Withheld, Dismissed, Withdrawn, or Dropped are held in the index for an average of 6 months, then routinely purged from the system and converted to microfiche (Potential for Error with missing or deleted files). Case information on microfiche must be ordered. There is NO public access to microfiche files.

FLAGLER COUNTY FLORIDA

Research of criminal record information is only permitted on Tuesday, and Thursday.

HILLSBOROUGH COUNTY FLORIDA

Public Access is available, however criminal case's with dispositions of Adjudication Withheld, Pre-trial intervention, and some deferred adjudication cases are only available through a Clerk search of their master index.
Delays can range from 24 hours to 2 weeks.

 

ANDERSON COUNTY KENTUCKY

Requests for information are being referred to the A.O.C. (Administrative Office of Courts) in Frankfurt. This will in effect make all requests for this county a "Statewide" search. Please weigh the costs involved.

GALLATIN COUNTY KENTUCKY

Court is closed on Wednesdays.

JEFFERSON COUNTY KENTUCKY

Possible Court Computer delays. System is up & down regularly.
In April of 2000, Jefferson county District courts deleted all SSN's from all records within the computerized
index system. A D.O.B. is now more important than ever when conducting a search through this jurisdiction.

MCCRACKEN COUNTY KENTUCKY

District Court records research is restricted to Thursdays' from 2:00pm to 4:00pm

TRIMBLE COUNTY KENTUCKY

Courthouse is closed on Wednesdays. – 24 hour delay for requests submitted on Tuesdays.

 

MASSACHUSETTS – ALL COUNTIES – CLERK ASSISTED SEARCH

All counties in this state routinely experience Court clerk or computer delay.Many counties have duplicated information on 3x5 index cards and docket books. Cards are subject to mis-filing, destruction, loss, and illegibility.

 

MISSOURI – ALL COUNTIES

The inclusion of a D.O.B. will help speed the return of results for all counties in this state.
HENRY COUNTY: Court clerk performs the actual search of the Associate Circuit court index. Primary Circuit court "public access" terminal is for Judgment information only. Criminal search requests are routinely referred to the Missouri State Highway Patrol.

 

HINDS COUNTY MISSISSIPPI

Files are ordered from offsite location. Not at the courthouse. This is typically a 24 to 72 hour delay for confirmation of identity.

LINCOLN COUNTY MISSISSIPPI

Lincoln county Justice center (Misdemeanors) restricts public record access to Monday & Friday Only from 10:AM to 3:PM

 

HILLSBOROUGH COUNTY NEW HAMPSHIRE

Dual county seats -North & South; both must be searched to provide a complete background check. Record searches in the Northern court are performed by the clerks' staff whom have been historically slow & understaffed.

 

NEW JERSEY – ALL COUNTIES – CLERK ASSISTED SEARCH

Delays are possible in every county. Requests for specific information are processed by a member of the clerks staff in every jurisdiction. No direct public access to actual case file information is provided.

 

NEW YORK BORROUGHS

In an effort to streamline the Criminal Record information departments of the various courts that process these requests, the O.C.A. (Office of Court Administration) has instituted a new policy effective July 14, 2003. A request for any jurisdiction identified as a Borough by the O.C.A. will now include any information that may be on file in any of the 62 counties that make up New York state.
The O.C.A. has not defined the regularity of how often all counties report to the central agency, what  information is reported (Felony, Misdemeanor, or both), and what information may or may not be included. Turnaround time is very fast (WITHIN 24 HOURS)

 

BROWN COUNTY OHIO

The following case information has been destroyed: D.U.I case files through 12/31/97
1st through 4th degree misdemeanor traffic & criminal cases with a final order date through 12/31/94.
Minor misdemeanor traffic & minor misdemeanor criminal case files with a final order date through 12/31/97.
Search warrant records with a last attempted service date of 12/21/94.

MADISON COUNTY OHIO

Court clerk performs the actual search in the Municipal (misdemeanors) court.

MIAMI COUNTY OHIO

Court clerks perform the actual search of the criminal index (Delays are likely) 

VAN WERT COUNTY OHIO

Municipal court is only accessible to researchers on Wednesdays.

WARREN COUNTY OHIO

Criminal record research is only permitted on Wednesday, & Friday.
Court clerks perform the actual search of the criminal index. (SSN based)

 

BERKELEY COUNTY SOUTH CAROLINA

Record information that has to be ordered will not be available until the following Wednesday, regardless of what day it was ordered.

CHARLESTON COUNTY SOUTH CAROLINA

Record information stored offsite will cause a 1 or 2 day delay to receive the actual case file for review.

 

FAIRFAX COUNTY VIRGINIA

Disposition information requires files to be ordered. (1 to 2 days to get the case file) Many independent city courts in Virginia are combined with the county court of the same name with no specification of where the offense occurred. (City or County) A search request for Fairfax City will require a search of the County court as well. This will ensure all possible records are located for either jurisdiction. Traffic tickets & misdemeanor criminal warrants with a final disposition prior to 1/1/88, that originated in the General District Court of Fairfax county, Fairfax City, City of Falls Church, Town of Vienna or the Town of Herndon have been destroyed.

 

WEST VIRGINIA – ALL COUNTIES

All magistrate courts (lower court) have removed ALL Identification except name from their respective county access systems. This will impact turn time as actual hard files will have to be ordered as a matter of routine in order to verify identity.
